Waymark Español

Terms of service

The rules of the road

These terms govern your use of the Waymark app. By using it you accept them; if you do not agree, please do not use it.

Effective October 11, 2026 · Version 1.0 · The Spanish version prevails if the two differ.

1. Who we are

Waymark is offered by Kevin Bayter (Skyfold Labs), based in Bogotá, Colombia. Contact: contact@skyfoldlabs.io.

2. The service

Waymark helps you plan trips and outings: itineraries, bookings, expenses, saved places, groups, AI suggestions, a voice copilot and memories. We may improve, change or retire features; if we retire a paid feature you have active, we will give you reasonable notice.

You must be at least 16 to use Waymark. If you are under 18 in Colombia, you need your legal representative's authorization.

3. Your account

You can use Waymark without an account or sign in with Google to sync and share. You are responsible for what is done from your account; tell us if you think someone is using it without permission. You can delete it any time under Profile → Settings → Delete my account (see how to delete your account).

4. Artificial intelligence and travel information

AI suggestions, opening hours, weather, flight status, entry and visa requirements, exchange rates and emergency numbers are for guidance only and may be wrong or out of date. Always check important information with the official source (airline, embassy, the venue itself) before deciding or paying. In an emergency, call local services.

You decide which suggestions to accept. Waymark is not a travel agency: we do not sell or manage bookings and are not a party to contracts you make with airlines, hotels or other providers.

5. Your content

What you create in Waymark (trips, notes, photos, expenses, itineraries) remains yours. You let us host, process and display it only as needed to provide the service, for example to sync it or show it to the people you share it with.

If you publish an itinerary, you give us a free, non-exclusive, worldwide license to show it to Waymark users, and you allow others to copy it into their own dates, while it is published. You can hide or delete it at any time. We automatically review itineraries before publishing and may remove those that break these terms.

6. Acceptable use

Do not use Waymark to:

We may suspend features or accounts that break these rules, proportionately and, where possible, with prior notice.

7. Waymark Pro, Ultra and the trip pass

8. Third-party services

Waymark uses services such as Google Maps, Google Gemini, DeepSeek, Open-Meteo and AeroDataBox. Their use inside Waymark is also governed by their terms; for example, maps and places are subject to the Google Maps Additional Terms and the Google Privacy Policy. We do not control and are not responsible for third-party content.

9. Intellectual property

The app, its design, brand and code belong to Waymark or its licensors. We give you a personal, non-exclusive, non-transferable license to use the app on your devices under these terms.

10. Liability

We provide Waymark with reasonable care but “as is”: we do not guarantee it will work without interruptions or errors. To the extent the law allows, we are not liable for indirect damages, losses from travel decisions based on the app's suggestions, or failures of third-party providers. Our total liability to you is limited to what you paid for Waymark in the 12 months before the event. None of this limits consumer rights that the law grants you and that cannot be waived, nor our liability for intent or gross negligence.

11. Termination

You can stop using Waymark and delete your account at any time. We may close accounts that seriously breach these terms or the law. If we shut down the service, we will give at least 30 days' notice so you can download your data.

12. Changes to these terms

We may update these terms. If a change is significant, we will tell you in the app before it applies; continuing to use Waymark afterwards means you accept it.

13. Governing law

These terms are governed by the laws of the Republic of Colombia. Disputes will be resolved by the competent courts of Bogotá, Colombia, without prejudice to your right to go to the Superintendence of Industry and Commerce or the courts of your domicile where consumer law allows. If you live in the European Union, you keep the protection of your country's mandatory rules.
